What Brazilian rules require of anyone selling a private flight, and how to check before you board.
The rule
Chartering a jet in Brazil means buying public air transport. The rule comes from ANAC, the civil aviation authority, and it applies to the operator and to whoever resells the flight.
On-demand air transport is operated by an air taxi company certified by ANAC under RBAC 135, with the operator certificate and operations specifications required by RBAC 119.
ANAC allows agencies to sell the flight, provided they give the passenger the details of the air taxi company operating it and the aircraft registration. In our proposal, both are written down before any payment.
The air taxi must hold RETA aviation insurance, with the cover defined by CNSP Resolution 442 of 2022. We ask the operator for the policy before ticketing.
Paid transport by someone who is not an air taxi leaves the passenger without insurance cover and can be a crime under article 261 of the Brazilian Penal Code. ANAC takes reports on 163.
Before you board
ANAC runs Voe Seguro, where you can check whether a company and an aircraft are authorised to fly air taxi. It is the quickest check and the most important one.
The registration is the code painted on the fuselage, and it ties the aircraft to the operator certificate. Without it in the proposal, there is nothing to check.
A price far below the market usually means a private aircraft flying for hire, which the rules do not allow. The right price comes with an operator name beside it.
The Voe Seguro check is public and free. We run the same check before sending any charter proposal.
Outside Brazil
Charter is operated by companies holding an FAA Part 135 certificate, from the American civil aviation authority.
The operator needs an air operator certificate issued under EASA rules, the European aviation safety agency.
ARGUS, Wyvern Wingman and IS-BAO are private safety audits an operator can show on top of its licence. They do not replace the authority, but they add to it.
Questions
Yes. Brazil's aviation authority, ANAC, allows resale as long as the passenger receives the details of the air taxi company operating the flight and the aircraft registration. In a WAYFARER proposal, both are written down before any payment.
Through Voe Seguro, the ANAC service where anyone can check whether a company and an aircraft are authorised to fly air taxi. The check takes a few minutes and uses the aircraft registration.
It is paid air transport by someone who is not a certified air taxi operator, such as a private aircraft charging for the flight. The passenger is left without the mandatory insurance cover, and in Brazil the practice can be a crime under article 261 of the Penal Code.
It is the sector where the aircraft flies back empty or repositions for another client. It can cost well below a full charter, but it depends on someone else's schedule: if the main flight changes, the leg changes with it.
